1. Description of Service

Push Up Hero is a fitness tracking app that helps you log pushups, track progress, and participate in challenges. The app is provided “as is” and we reserve the right to modify, suspend, or discontinue any part of the service at any time.

2. Account and Eligibility

You must be at least 13 years old to use the app. You are responsible for maintaining the confidentiality of your account and for all activity under your account. You must provide accurate information when creating your account.

3. Acceptable Use

You agree to use the app only for lawful purposes. You will not:

• Use the app in any way that violates applicable laws
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the app or its infrastructure
• Use the app to harass, abuse, or harm others
• Submit false or misleading workout data

We may suspend or terminate your account if you violate these Terms.

4. Subscriptions and Payments

Some features may require a paid subscription. Subscription terms, pricing, and renewal are governed by Apple's App Store terms. Payments are processed by Apple. Refunds are handled by Apple according to their policies. We do not provide refunds directly.

5. Intellectual Property

The app, including its design, content, and software, is owned by us or our licensors. You may not copy, modify, distribute, or create derivative works without our written permission.

6. Disclaimer of Warranties

The app is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or secure.

7. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the app. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim, or one hundred dollars, whichever is greater.

8. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the app or your violation of these Terms.

9. Termination

You may delete your account at any time via the app. We may terminate or suspend your access for violation of these Terms or for any other reason. Upon termination, your right to use the app ceases immediately.

10. Governing Law

These Terms are governed by the laws of the United States and the State of Minnesota, without regard to conflict of law principles.

11. Changes

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms and updating the “Last updated” date. Continued use of the app after changes constitutes acceptance of the new Terms.
